  Now more than ever it is crucial that we seek to identify and minimise the commercial risks posed to our sector by government legislation. It is therefore incumbent upon BCSC to communicate to key decision makers that as an industry, we can no longer be expected, nor can we afford, to shoulder additional burdens imposed on us by Westminster’s policy makers.

In order to effectively communicate our activity in this area we will be providing you with a quarterly update on potential legislative issues affecting your business and what we are doing to mitigate the impact of government intervention. We aim to identify issues that may be of direct relevance to your operations sufficiently far enough in advance to ensure that there is still time for proactive and successful intervention.

Community Infrastructure Levy (CIL)  
     
  The Government consulted on draft regulations for the implementation of the Community Infrastructure Levy (CIL) over the summer in 2009. The consultation ended on 23 October 2009 and consultation responses are now being analysed. Further announcements on CIL will be made shortly.

Affordable retail rents - London  
     
  In 2008 Mayor Boris Johnson stated: "My proposals aim to help... offering small retailers the opportunity to make a success of their enterprise both by making more suitable premises available and taking steps to level the playing field by securing affordable rents."

In October 2009 the London Assembly's Planning and Housing Committee agreed to carry out a short review of how the planning system, and other initiatives, can provide support for London's local and neighbourhood shops and small independent shops. The findings of the review will form the Assembly's contribution to policy development as part of the London Plan review process.

  Government published the new Planning Policy Statement 4 (PPS4) on 29 December 2009, setting out its comprehensive policy framework for planning for sustainable economic development in urban and rural areas.

Energy Performance of Buildings Directive (EPBDII)  
     
  Ahead of the Copenhagen Climate Change summit, the EU came to an agreement on the recast of the Energy Performance of Buildings Directive.

Secondary Centres: The Impact of the Recession on Secondary Shopping Centres  
     
  We recently published our report Secondary Centres: The Impact of the Recession on Secondary Shopping Centres. The report identifies that many secondary shopping centres have witnessed dramatic falls in capital values due to the financial crisis of late 2008 / early 2009. Centres that are most at risk are those that are highly debt leveraged. It has been estimated that just over £10.1 billion worth of shopping centres were and still are at risk. The plight of secondary centres falling into further decline is an issue that has to be addressed, primarily by the banks and their borrowers, as the social impact of these deteriorating assets on communities could be detrimental.
